O R D E R

The grievance of the petitioner was with regard to the action of the police authorities in opening a rowdy sheet in his name on the file of Jagtial Rural Police Station, Karimnagar District. The Station House Officer, Jagtial Rural Police Station, Karimnagar District, filed a counter-affidavit stating that the petitioner was involved in four criminal cases and in three of them he had already been convicted and fined. He further stated that the fourth case, arising out of Crime No.20 of 2008 registered under Sections 427, 447 and 506 IPC read with Section 3(i)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, was pending trial before the competent criminal Court.

Owing to the involvement of the petitioner in these criminal cases, he stated that a rowdy sheet had been opened in his name and was being extended from time to time. He further stated that the petitioner would have to await the outcome of the last case which was pending adjudication before the competent Court. Sri P. Shiv Kumar, learned counsel for the petitioner, produced a copy of the judgment dated 21.01.2015 passed by the learned Special Sessions Judge for Trial of Offences under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act-cum-V Additional District and Sessions Judge, Karimnagar, in Special Sessions Case No.63 of 2012. This was the case which was taken on file upon a charge-sheet being laid in Crime No.20 of 2008 on the file of the Jagtial Rural Police Station.

In the light of the aforestated development, it is for the police authorities to consider the question as to whether a rowdy sheet requires to be maintained against the petitioner. The Superintendent of Police, Karimnagar, shall accordingly re-examine the issue in the light of the acquittal of the petitioner in the last and final pending case and in the event the petitioner was not involved in any criminal activity thereafter, he shall decide as to whether the rowdy sheet requires to be maintained against him as per the relevant provisions at this stage. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order. The writ petition is disposed of with the above directions. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
