THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22932 of 2016 ORDER:

The petitioner was appointed as a driver in the year 2008 on contract basis in Medak region after undergoing due process of selection. His services were regularized with effect from 01.12.2011. Thereafter, his designation was changed as Driver-cum-Conductor with effect from 07.02.2016. At present he is working in the Dubbaka depot, which is a satellite to Siddipet depot. It appears that in connection with a check conducted on 27.03.2016 departmental proceedings were initiated, which resulted in issuing the impugned show cause notice for removal from service on 30.06.2016. Challenging the said show cause notice for removal from service, the present Writ Petition is filed. A perusal of the show cause notice shows that a detailed enquiry was conducted on 30.05.

2016 and the present notice is issued asking for the explanation from the petitioner pursuant to the report submitted in the said enquiry. Since this is a show cause notice, this Court is not inclined to go into the merits of the case, but gives liberty to the petitioner to submit his explanation and also avail the opportunity of personal hearing provided to him under the impugned order. Since the time granted in the show cause notice had expired, the petitioner is granted time till 22.07.2016 for submitting the explanation and seeking personal hearing.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
