HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2590 of 2013 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioners/A1 to A4, seeking to quash the proceedings in C.C No. 361 of 2012 on the file of Judicial First Class Magistrate, Rajam, Srikakulam District, wherein the petitioners/accused are charged against offences under Section 498-A, r/w Section 109 IPC and Sections 3 & 4 of Dowry Prohibition Act, 1961.

When the matter came up for hearing today, Sri S.R. Sanku, learned counsel for petitioners submitted that the petitioners need to raise valid pleas which include the jurisdiction of the Court at Rajam to try the case and therefore liberty may be given to the petitioners to raise all the relevant defence pleas before the trial Court by dispensing with the presence of the petitioners before the trial Court and with the said liberty the petition may be closed.

Purushotham, is present and submitted no objection for

this course.

In the light of the above submission, petitioenrs/A1 to A4 are permitted to take all the relevant defence pleas legally permissible to them before the trial Court to vindicate their defence stand and the trial Court shall pronounce judgment on merits. At request of the learned counsel for petitioners, the appearance of petitioners/A2 to A4 is dispensed with before the trail Court except on the occasions when the trail Court specifically requires their presence.

Accordingly, the Criminal Petition is dismissed. As a sequel thereto, miscellaneous applications pending, if any, shall stand closed.
