THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10658 of 2016 ORDER:

Heard Sri Ganta Rama Rao, learned Senior Counsel appearing for Sri Ganta Sridhar, learned counsel for the petitioner, and Sri Nimmagadda Venkateswarlu, learned Standing Counsel for the Kovuru Municipality. The prayer of the petitioner in this case is as under: "The petitioner prays this Hon'ble Court may be pleased to issue an appropriate Writ or order or direction particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent in disposing of the application dated : 21.12.2015 which was submitted on 22.12.2015 for grant of permission for laying the cable for providing Cable Television Services within the limits of the respondent municipality, as arbitrary, illegal and to pass such other order/s as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The petitioner's application dated 21.12.2015, whereby it sought permission from the municipal authorities for laying cable, is still pending consideration. In that view of the matter, this Court sees no purpose in entertaining this writ petition for adjudication on merits as it is for the authority concerned to consider the said application on its own merit and take a decision. The writ petition is accordingly disposed of directing t h e Kovuru Municipality to consider the petitioner's application dated 21.12.2015 in accordance with law and take appropriate action thereon. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order.
