HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15895 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 4th respondent in issuing Form-3 permission vide proceedings in L.Dis.No.155/2016 A, dated 27.08.2016 and consequent proceedings in S.R.No.155/2016 C.S., dated 10.03.2017, directing the 6th respondent to sanction electricity connection to the bore well dug by 7th respondent, unauthorisedly, in Survey No.70-1 of Bhudevipeta Village, Gajapathinagaram Mandal, Vizianagaram District, as illegal and arbitrary and contrary to the provisions made under A.P.Water, Land and Trees act, 2002 (WALTA Act) and Rules made there under.

Learned counsel for the petitioner submits that the petitioner filed appeal before the 2nd respondent against the orders passed by the 4th respondent granting permission to the 7th respondent to dug bore well, but as on today, no orders are passed by the 2nd respondent either in the appeal or stay petition.

Heard learned Assistant Government Pleader for Revenue.

Since it is stated that appeal filed by the petitioner is pending before the 2nd respondent against the proceedings

dated 27.08.2016 passed by the 4th respondent, I am not inclined to issue any directions in the writ petition. However, the 2nd respondent is directed to dispose of the appeal filed by the petitioner, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and affected parties. Accordingly, the writ petition is disposed of. No order as to costs.
