Heard learned counsel for petitioner and learned Government Pleader for Home.

This writ petition is filed alleging that pursuant to the registration of crime bearing FIR.No.520 of 2010, Chandanagar Police Station, petitioner has been called to the police station and said action of calling to the police station would amount to offending his right to life and liberty, and wthout any justification, petitioner cannot be called to the police station.

03. Based on the written instructions furnished by Inspector of Police, Chandanagar Police Station, dated 18-03-2019, learned Government Pleader would submit that Criminal Petition No.6614 of 2011 was filed before this Court challenging the registration of crime and the case was disposed of only on 05-02-2018. Thereafter, investigation is taken-up. However, according to learned Government Pleader, petitioner was not shown as accused in the said crime and he is not called to the police station as alleged. In view of the said assertion of the learned Government Pleader, basing on instructions furnished by Inspector of Police, the apprehension expressed by the petitioner that he is being called to the police station no more survives.

04. In view of the same, the writ petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
