THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22941 OF 2016 ORDER:

Heard the learned counsel for the petitioners; the learned Government Pleader for Minorities and Welfare; the learned Government Pleader for Revenue and Sri S.Arifullah, learned Standing Counsel for A.P. Wakf Board. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present writ petition came to be filed seeking issuance of the writ of Mandamus declaring the action of the respondent authorities in threatening to dispossess the petitioners from their lawful possession in respect of the land in Sy.No.247 admeasuring Ac.4.20 cents situated at Kovuluru Village, Panyam Mandal, Kurnool District, without issuing any notice to the petitioners herein and without following the due procedure contemplated under the Law, as being illegal, arbitrary, unconstitutional and violative of Article 14, 21 and 300-A of the Constitution of India and consequently direct the Respondent authorities not to take any coercive action without following the due process of Law.

3. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondents not to dispossess the petitioners from the subject land without following due process of law.

4. While denying the averments made in the writ petition, learned Standing Counsel for the 2nd respondent submits that no action shall be initiated by the respondents without following due

process of law.

5. Having regard to the submissions made and without going into the merits of the case, the Writ Petition is disposed of directing the respondent authorities not to dispossess the petitioners from the land in survey No.247 admeasuring Ac.4-20 cents at Kovuluru Village, Panyam Mandal, Kurnool District, without following due process of law.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
