The writ petition was filed to declare the action of the respondent Nos.2 to 4 in allowing respondent Nos.5 & 6 in completing the multi-storied building bearing No.26-14-37, DNR College Road, Bhimavaram, West Godavari District without any approved plan without following the provisions of A.P. Municipalities Act and the Rules and Bye-laws made thereunder and A.P. Apartments Act, as illegal and arbitrary.

W.P.M.P.No.2173 of 2015 was filed by the learned counsel for the petitioner to permit her to withdraw the writ petition with a liberty to institute a fresh writ petition challenging the regularisation proceedings issued by the 2nd respondent in favour of respondents 5 and 6, who are constructing multi-storied building illegally. This court passed order dated 05.02.2015 permitting the petitioner to withdraw the writ petition but without granting the liberty as sought for. Hence the matter was posted under the caption "For Being Mentioned".

Accordingly the order dated 5.02.2015 is modified and the writ petition is dismissed as withdrawn with liberty to the petitioner to institute a fresh writ petition challenging the regularisation proceedings issued by the 2nd respondent in favour of respondents 5 and 6. No costs.
