HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.1047 of 2018 ORDER:

Aggrieved by the order of the Court below merely appointing an Advocate Commissioner to note down physical features of the plaint schedule property, but not directing the Commissioner to measure the property with the assistance of a Mandal Surveyor, the plaintiff in a suit for bare injunction has come up with the above revision.

2. Heard Sri D. Ramakrishna, learned counsel for the petitioner.

3. In a suit for bare injunction, the question of measuring the suit property with the help of Mandal Surveyor does not arise. The petitioner should be happy that a Commissioner is appointed to note down the physical features of the property. Therefore, I find no reason to interfere with the order of the Court below.

4. Hence, the Civil Revision Petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
