SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1601 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused in Crime No.2 of 2018 on the file of the Station House Officer, Chirala I Town Police Station, Prakasham District. The offences alleged are under Sections 427, 447 and 506 of the Indian Penal Code. Heard the learned counsel for the petitioner/accused, learned Public Prosecutor appearing for the respondent-State, and perused the record.

The allegation against this petitioner is that he went to the hospital of the de facto complainant, where the wife of the petitioner is working and abused and threatened her. He also destroyed the property present in the office room. Counsel for the petitioner submits that earlier, the wife of the petitioner filed a case against the petitioner for the offences under Sections 498-A, 307 and 506 IPC and the said case ended in acquittal.

Ending of the said case in acquittal has no bearing, more so when the complainant in this case is a third person and when the incident occurred in a public place. The nature of the allegations does not entitle the petitioner for grant of anticipatory bail. Considering the facts and circumstances and nature of allegations, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the

bail application of the petitioner on merits and in accordance with law, on the same day subject to the regular pressure of work. With the above observation, this Criminal Petition is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed.
