THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.6485 of 2017 ORDER:

This Criminal Petition is filed, by the petitioner-accused No.3, under Sections 437 and 439 of Cr.P.C., seeking bail in Crime No.117 of 2017 on the file of the Station House Officer, Anakapalli Town Police Station, Visakhapatnam District, registered for the offence punishable under Section 8(c) read with 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

Heard the learned counsel for the petitioner. 3.

The learned Additional Public Prosecutor opposed the bail. 4.

It is the case of the prosecution that on 23.05.2017 the police on receiving credible information visited the Railway Bridge, Anakapalli and intercepted two autos bearing No.AP 31 TC 8417 and another is unregistered and one motorcycle bearing No.AP 31 BL 4260 and seized 240 kgs. of ganja, which is a commercial quantity. It is the further case of the prosecution that the ganja, which was being transporting, was purchased by the petitioner. After completion of the necessary formalities, the above crime was registered.

The petitioner along with other accused filed Crl.M.P.No.1645 of 2017 on the file of the Court of the Metropolitan Sessions Judge-cum-Special Judge for trial of offences under NDPS Act at Visakhapatnam and the same was dismissed.

A perusal of the CD file reveals that the investigation is in progress.

As rightly pointed out by the learned Additional Public Prosecutor, if the petitioner is released on bail at this stage, the possibility of tampering with the prosecution witnesses cannot be ruled out.

Taking into consideration the nature of the offence alleged to have been committed by the petitioner, this Court is of the considered view that it is not a fit case to grant bail to the petitioner.
