HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 4 4 8 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions filed by the Sub-Inspector of Police, Bheemunipatnam Town P.S., Visakhapatnam City, dated 14.02.2018 are placed on record by the learned Government Pleader. The said instructions to the extent of relevance of the present Writ Petition read as under: - "It is further submitted that since both the parties have been indulging in frequent altercations in the above civil dispute between them causing breach of peace in the area, a case in Cr.No.361/ 2017, dt.03.12.2017, u/ s.107, 145 Cr.P.C. was registered on the file of the Bheemunipatnam P.S., against both the parties i.e., the petitioner herein & 4th respondent herein along with their supporters, wherein the subInspector of Police, Bheemunipatnam P.S.

, has laid the information before the Mandal Executive Magistrate, Bheemunipatnam on 03.12.2017 u/ s.107 and 145 Cr.P.C. to bind over both the parties and to issue proceedings u/ s.145 Cr.P.C., with a view to maintain public peace and tranquility in the area. The same is pending on the file of the Mandal Executive Magistrate, Bheemunipatnam.

In view of the facts and circumstances explained above, the contention of the petitioner that 3rd respondent has been interfering in the civil disputes of the petitioner with the 4th respondent and threatening the petitioner for settlement with the 4th respondent is absolutely false and baseless. All other allegations of the petitioner against the respondent police authorities are concocted only for the sake of filing this Writ Petition and the same are hereby specifically denied."

Having regard to the above said instructions and taking into consideration the submissions made by the learned Counsel appearing for the petitioner and the learned Government Pleader and also the learned Counsel appearing for the Unofficial respondents, this Court deems it fit and proper to dispose of the Writ Petition giving liberty to the petitioner to avail the remedies available to him under law.
