THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.3307 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ Accused in C.C.No.500 of 2010 on the file of III Additional Chief Metropolitan Magistrate at Gajuwaka, arising out of Crime No.299 of 2010 of Gajuwaka Police Station, Visakhapatnam, registered for the offences punishable under Sections 420 and 506 IPC. Heard and perused the material on record.

After arguing for sometime, the learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.

In any event, considering the facts and circumstances of the case, the presence of the petitioner before the trial Court is dispensed with except on the dates when the learned Judge insists for the same for the purpose of framing of charges and for examination under Section 313 Cr.P.C. and the petitioner shall be properly represented by his counsel.

Accordingly, the criminal petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
