THE HONOURABLE DR.JUSTICE G. RADHA RANI CRIMINAL PETITION No.2322 of 2024 O R D E R:
This Criminal Petition is filed by the petitioner - A3 under Section 438 of Code of Criminal Procedure for grant of anticipatory bail in the event of his arrest in Crime No.221 of 2023 on the file of PS Chevella, registered for the offences under Sections 467, 471, 420, 384, 506, read with Section 34 of IPC and Sections 3(1)(iv), 3(1)(v) and 3(1)(x) of SC / ST (Prevention of Atrocities Act, 1989.

Heard the learned counsel for the petitioner - A3 and the learned Additional Public Prosecutor.

Learned counsel for the petitioner submitted that this Court granted bail to the petitioners - A2 and A4 vide Criminal Petition No.1627 of 2024 on 14.02.2024. The petitioner also would stand on the same footing as that of A2 and A4 and prayed for grant of anticipatory bail to the petitioner,. 4.
Learned Additional Public Prosecutor opposed grant of anticipatory bail to the petitioner on the ground that SC / ST Act was also invoked. 5.
Considering the facts and circumstances of the case, wherein this Court by relying upon the judgment of the Kerala High Court in Juli C.J. v. State of
Dr.GRR, J crlp_2302_2024 Kerala1 granted anticipatory bail to A2 and A4 and the petitioner also stands on the same footing, it is considered fit to grant anticipatory bail to the petitioner - A3 on certain conditions.

In the result, the Criminal Petition is allowed and the petitioner - A3 will be released on anticipatory bail subject to following conditions: i. The petitioner - A3 is directed to surrender before the Station House Officer of PS Chevella within fifteen (15) days from the date of this order. On such surrender, the Station House Officer of PS Chevella shall release the petitioner - A3 on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties for the like sum each to the satisfaction of the said Station House Officer.
ii. The petitioner - A3 shall abide by the conditions stipulated under Section 438(2) of Cr.P.C. and shall cooperate with the Investigating Officer in investigation of the case.
As a sequel, miscellaneous applications pending in this petition, if any shall stand closed.
