THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1114 OF 2016 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioner-A.6 seeking anticipatory bail in connection with Crime No.394 of 2015 on the file of P.S. RGI Airport, Shamshabad, R.R.District registered for the offences under Sections 420, 468, 471 of IPC and Section 24 of Immigration Act. Heard the learned counsel for the petitioner and learned Additional Public Prosecutor. Perused the material on record. The case of the prosecution is that A.1 travelled to Dubai for a short term visit based on the visa created by other accused. It is the further case of the prosecution that A.4 confessed that with the help of A.5 and A.6 he created the fake visa in favour of A.1. In the remand report it is not stated the manner in which the petitioner herein helped A.4 in creating the fake visa.

Further the main accused was arrested and subsequently, released on bail. Considering the said facts and circumstances, this Court is of the view that grant of bail to the petitioner will not cause any prejudice to the investigation, if he is released with some stringent conditions. Accordingly, the petitioner-A.6 is directed to surrender before the Magistrate concerned on or before 24.02.2016 and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with one surety for the likesum to the satisfaction of the Magistrate concerned. Further the petitioner is directed to report before the Station House Officer concerned daily between 10.00 a.m. and 5.00 p.m. until further orders.

The Criminal Petition is allowed accordingly.
