This appeal is preferred by the appellant/ claimant, assailing the judgment of the Motor Accidents Claims Tribunalcum-VIII Additional District Judge (Fast Track Court), West Godavari District at Eluru, dated 08.03.2011, in OP No.308 of 2008, on the ground that the compensation awarded is inadequate.

This is a case where the claim is for the simple injuries sustained by the claimant in the accident. A perusal of the judgment shows that the court below has very generously awarded certain amounts towards damages of clothing, extra nourishment, and pain and suffering. Rs.1,000/ - was awarded towards damage of clothing in spite of there being no evidence, as against the claim of Rs.22,000/ -, which cannot be found fault with.

Considering that the injuries sustained by the claimant are four simple injuries, the court below awarded Rs.6,000/ - towards pain and suffering; Rs.2,000/ - towards extra nourishment and towards attendant charges Rs.1,000/ - was awarded in spite of the fact that the appellant did not adduce any evidence whatsoever in proof of the same.

Hence, this court opines that there is absolutely no reason to interfere with the judgment of the court below. Accordingly, the MACMA is dismissed.
