THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.2208 of 2015 ORDER :
The petitioner, who is the sole accused, filed the present application under Section 438 of Cr.P.C. seeking release in the event of his arrest in connection with Crime No.435 of 2014 of Nacharam Police Station, Cyberabad, Ranga Reddy District, registered for an offence punishable under Section 306 of IPC.
Though the present application is filed seeking anticipatory bail, learned counsel for the petitioner restricts his prayer seeking a direction to be given to the Sessions Court to consider his request of granting bail in the event of surrender.
Having regard to the circumstances of the case and taking into consideration the nature of allegations made against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. However, the petitioner, if so advised, shall surrender before the concerned Court and move an application for grant of bail before appropriate Court after giving prior notice to the Public Prosecutor, in which event the same shall be dealt with, in accordance with law, at the earliest.
