HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.548 OF 2017 ORDER:

Heard learned counsel for petitioner, who went unsuccessful from dismissal of his application on 22.02.2017 in Crl.M.P. No.38 of 2017 in M.C. No.169 of 2012 by the Judge, Family Court, Ranga Reddy District at L.B Nagar, to receive the documents despite no objection stated by the petitioner in M.C No.169 of 2012 including representing petitioner No.2, saying at the time of filing an application to reopen the evidence of the respondent that was allowed on 18.01.2017 and the document dated 17.06.2016 said to have been filed and for no other grounds to allow.

2) In fact, the very order when it reads that the MC petitioners stated no objection and already filed petition to reopen the evidence, which was allowed by permitting further evidence of the revision petitioner, the lower Court ought to have allowed the petition, thereby otherwise notice is required from the no objection reported before the lower Court, which is reflected from the impugned docket order of the lower Court. 3) Having regard to the above, since no purpose served keeping the matter pending and suspending the further proceedings and ordering notice to the revision respondents 1 and 2, the revision is allowed directing the lower Court to receive the document and proceed according to law.

Dr SSRB, J Clrc_548_2017 4) Consequently, pending miscellaneous petitions, if any, shall stand closed.
