THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23521 of 2016 ORDER:
The petitioner is working as a Manager in the respondent bank and was promoted as Scale I Officer on 24.04.2008. He was transferred to Chennai Zone and completed two terms during the period 2008 to 2011. He worked in Greater Mumbai Zone from 2011 to 2014. He states that he is a native of Hyderabad. He was transferred to Hyderabad Zone on his request on 14.08.2014 and he has been working in Panjagutta and Gunrock Enclave branches. Now he is promoted as Scale II Manager and transferred to Dharward High Court Road Branch as Head of the Branch by proceedings dated 14.06.2016. He sought modification of the said order by his representation dated 15.06.2016. Now the present Writ Petition is filed challenging the order of transfer.
When the matter is taken up for consideration, learned Counsel appearing for the respondents produced before this Court a copy of the proceedings of the Chief Manager, dated 15.07.2016, relieving the petitioner in absentia from his duties with effect from 15.07.2016 after office hours in order to enable him to report at the transferred office. This Court will not normally interfere with the transfer proceedings unless they are arbitrary or illegal. In the instant case, the petitioner was promoted as Scale II officer and was posted to a different place from the place where was working previously. Though the order of transfer was passed on 14.06.2016, he did not get himself relieved pending decision on the representation submitted by him on 15.06.2016.
The petitioner appears to be on leave and now he is relieved in absentia with effect from 15.07.2016.
In the circumstances, this Writ Petition is dismissed, but the dismissal of the Writ Petition will not prevent the respondents from considering the representation of the petitioner dated 15.06.2016 and
passing appropriate orders thereon. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
