HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.1954 of 2013 ORDER:

This writ petition is filed to declare the inaction of the respondents in demolishing the wall constructed in the middle of the road situated in bye-lane to Street No.3, Tarnaka, Hyderabad, by anti social elements and land grabbers as illegal and arbitrary.

According to the petitioner, on 18.8.2012 nearly 10 to 12 anti social elements have constructed a wall closing the bye-lane; the petitioner was out of station and as such he could not stop the illegal construction; a complaint was lodged before the police to take action and to remove the illegal wall constructed by the anti social elements, but, no action has been taken by them.

In view of the facts and circumstances of the case, the Writ Petition is disposed of giving liberty to the petitioner to file a representation before the 2nd respondent setting forth his grievance, and if any such representation is made, the 2nd respondent is directed to dispose of the same, in accordance with law.
