HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.1968 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioner/ accused seeking to modify the order dated 01.12.2017 in Crl.M.P.No.26 of 2017 in Crl.A.No.150 of 2017 passed by the Additional District and Sessions Judge, Hindupur, whereby and whereunder learned Judge while granting suspension of sentence till 05.01.2018, directed the petitioner to deposit Rs.50,000/- on or before 05.01.2018 and observed that failure to deposit, the order shall stand cancelled.

2) Learned counsel for petitioner would submit that petitioner is hardpressed for money and therefore, the direction of the lower Appellate Court to deposit Rs.50,000/- will cause any amount of hardship to her and hence the said amount may be reduced.

3) It is seen that the petitioner is admittedly working as Headmistress in MPP School, Penukonda Mandal. Considering the employment status of the petitioner, the order of the lower Appellate Court cannot be said to be illegal.

4) Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous applications pending if any, shall stand closed.
