THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.2634 of 2016 JUDGMENT:

This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C.

challenging the docket orders dated 27.09.2016 in Crl.M.P.No.871 of 2015 in M.C.No.238 of 2014 on the file of the Court of the Additional Metropolitan Sessions Judge for the trial of JHCBBC cum Additional Family Court cum XXIII Additional Chief Judge, at Hyderabad. When the matter is taken up for hearing, learned counsel for the petitioner seeks permission of this court to permit the petitioner to withdraw the Criminal Revision Case with a liberty to file a petition before the trial Court to recall NBW(Non-bailable Warrant). He further submitted that the trial Court may be directed to dispose of the petition of the petitioner on the same day. Permission is granted.

Having regard to the facts and circumstances of the case, this Criminal Revision Case is dismissed as withdrawn granting liberty to the petitioner to file a petition before the trial Court to recall the NBW. The trial Court is hereby directed to dispose of the recall petition, if any, filed by the petitioner on the same day in accordance with law. As a sequel, the miscellaneous petitions, pending if any, shall stand closed. _____________________ T.
