THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.12458 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners/accused Nos.1 and 2 in C.C.No.560 of 2013 on the file of the Court of the VI Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.
2 At the time of arguments, the learned counsel for the petitioners seeks permission of the Court to permit the petitioners to withdraw the petition with a liberty to avail the remedies available to them under law, including filing of a petition under Rule 37 of Criminal Rules of Practice before the trial Court. Permission accorded.
3 In the result, the Criminal petition is dismissed, granting the liberty as prayed for, with a further direction to the trial Court that if a petition under Rule 37 Criminal Rules of Practice is filed, the same shall be disposed of in accordance with law. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
