The present writ petition came to be filed seeking issuance of writ of Mandamus declaring in action of the respondents in not resurveying the land and fixing the boundaries correctly as illegal, arbitrary and violative of principles of natural justice and also violative of Article 300-A of the Constitution of India and consequently to direct the respondents to survey and fix the boundaries correctly for the land admeasuring Ac.4.00 cents covered by Survey No.25/1 of the Jaggarajupeta Village of Gajuwaka Mandal, Visakhapatnam.
Though various grounds are raised, the learned counsel for the petitioner restricts his prayer questioning the in action of the respondents in not conducting survey and fixing the boundaries. Learned Government Pleader for Revenue submits that this writ petition is filed in the year 2005 and it may not possible to trace out the said application at this stage.
Accordingly, the writ petition is disposed of directing the petitioner to make a fresh application in Form VI through on line, as per procedure, in which event the authorities concerned shall consider the same and pass orders thereon in accordance with law, as early as possible preferably within a period of six to eight weeks from the date of receipt of application. There shall be no order as to costs. Miscellaneous petitions, if any, pending in the petition, shall stand closed.
