THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION No.7205 OF 2016 ORDER:

The petitioner - A8 seeks regular bail under Sections 437 and 439 Cr.P.C.

The allegation is that the petitioner along with other accused committed offences under Section 420 read with 34 I.P.C. and Section 489-C I.P.C. for preparing and circulating counterfeit currency.

The prosecution case is that earlier the petitioner was granted bail and subsequently, when he failed to turn up to the Court, Non-bailable Warrant was issued against him and the original case was split up and registered as P.R.C.No.1 of 2016 on the file of Additional Judicial Magistrate of First Class, Narsapur, West Godavari District, and subsequently, on PT Warrant, he was remanded to judicial custody on 26.02.2016. Hence, the instant bail application.

Heard.

Learned counsel for the petitioner while denying the offences submitted that since the petitioner was arrested in connection with another case, he could not attend in the present case but he has not voluntarily jumped out of the bail and therefore, bail may be granted to the petitioner to enable him to defend the case. A perusal of the record would show that the petitioner jumped out of bail and thereby the case had to be split up against him as P.R.C.No.1 of 2016 on the file

of Additional Judicial Magistrate of First Class, Narsapur. It infers that he has scant respect for law. The offences alleged against the petitioner and other accused being grave, it is not a fit case to grant bail. Accordingly, the petition is dismissed. However, in view of the submission of the learned counsel for petitioner that the P.R.C. has been committed to the Principal Sessions Court, Eluru, the concerned trial Court is directed to complete the trial at the earliest, positively within four months from the date of case being made over to it.
