THE HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.NO.26753 OF 2007 ORDER:

This writ petition is filed seeking to declare the action of the respondents in trying to interfere with the petitioner's peaceful possession and enjoyment of plot Nos.206 and 207 admeasuring 200 Sq.yards each in Sy.No.79, situated at Ram Rahim Nagar, Hafizpet old Village, Serilingampally Mandal, Ranga Reddy District without following due process of law as illegal, arbitrary and violative of Articles 14, 21 and 300A of the Constitution of India and consequently direct the respondents not to interfere with the petitioner's possession and enjoyment of the above mentioned property.

It is the case of the petitioner that he is the owner of plots bearing Nos.206 and 207 admeasuring 200 Sq.yards each in Sy.No.79, situated at Ram Rahim Nagar, Hafizpet old Village, Serilingampalli Mandal, Ranga Reddy District and the said plots have been purchased vide registered sale dated 13-8-1998 and since then, he is in peaceful possession and enjoyment of the same. While the matter stood thus, the respondents tried to interfere with the property of the petitioner on the allegation that it is a Government land. Hence, the writ petitioner is before this Court. 3.

At the time of admitting this writ petition on 14-12-2007, this Court granted interim direction in W.P.M.P.No.34927 of 2007 and since then, the petitioner is in peaceful possession of the property in pursuance of orders passed by this Court.

Mr.Pavan Reddy, Assistant Government Pleader for Revenue (Telangana State) on instructions would submit that there is no record to show that the land pertains to the Government as on date and in the event if it is found that the said land belongs to the Government, the Government is at liberty to proceed against the same as per law.

Recording the above submission, the writ petition is allowed, directing the respondents not to interfere with the peaceful possession and enjoyment of the petitioner over the subject land, without following due process of law. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
