THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.5787 of 2004 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the Order No.PA/20(102)/97-RM'T' dated 25.05.2000 issued by the 2nd respondent as arbitrary and illegal and contrary to the judgment in STC No.882 of 1996 dated 07.10.1999 on the file of the Court of Special Judicial Magistrate of First Class for Excise, Chittoor and consequently set aside the said order dated 25.05.2000 and direct the respondents to treat the period from 23.10.1996 to 25.05.2000, when the petitioner was kept out of service, as the period spent on duty with salary and further direct the respondents to restore the pay of the petitioner, grant annual increments and with all other consequential benefits monetary and otherwise and pass such other necessary orders.

No representation on behalf of the petitioner on 28.03.2016 and the matter is posted to today 'for dismissal'. Today also even the matter is listed under the caption 'for dismissal', there is no representation on behalf of the petitioner. It seems that the petitioner is not interested to prosecute the matter.

Hence, the writ petition is dismissed for default. Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
