THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.1257 of 2017 ORDER :

Petitioner has filed this Writ Petition assailing the order dt.21-11-2016 passed by the 2nd responding suspending the petitioner pending enquiry.

It is not in dispute that a charge memo dt.21-11-2016 has also been issued to petitioner levelling certain allegations that she had been grossly negligent in the performance of her duties. 3.

Though learned counsel for petitioner sought to contend that petitioner is innocent and her subordinate one D.K. Prakash is the person, who has been found in the preliminary enquiry to be actually responsible for the loss caused to the Corporation, I am not inclined to go into the said aspect since the petitioner has submitted an explanation to the said charge memo and respondents would conduct a departmental enquiry in compliance with the applicable Rules and principles of natural justice and petitioner would have an opportunity to defend herself therein.

Therefore the Writ Petition is disposed of directing the respondents to complete the enquiry into the charges framed against petitioner within a period of three (03) months from the date of receipt of copy of this order in compliance with the principles of natural justice and the applicable Service Rules. No costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
