HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.17490 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of shop No.15, Kallagalla Village, Kuderu Mandal, Anantapur District. The fourth respondent, along with his subordinates, inspected the fair price shop of the petitioner and seized the stock stating that there was variation. The fourth respondent submitted a report to the third respondent, based on which, the third respondent issued a show cause notice-cum- suspension order on 15.05.2015. Based on the report of the fourth respondent, the second respondent, without conducting any enquiry, initiated 6-A proceedings against the petitioner. Hence the Writ Petition.
In view of the allegations levelled against the petitioner, this Court is not inclined to interfere with the order dated 15.05.2015 passed by the third respondent. The third respondent is directed to conduct an enquiry, pursuant to the show cause notice dated 15.05.2013, duly observing the principles of natural justice, and pass an order, within a period of thirty days from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs. _______________________________ A. RAMALINGESWARA RAO,J Date:07.07.2015
