Heard Mr Krishna Kishore Kowuri' learned counsel for the petitioner/accused and the learned Additional Public Prosecutor for the State-ResPondent Perused the material on record'

Case of the Petitioner is that C.C.No.224 of 2022 was filed against him. During the course of trial' the' previous counsel for the accused cross-examined PWs' 1 and 2' however' some crucial ( / points are omitted, which are very much related to prove their case and for proper adjudication of the matter'

Learned counsel for petitioner submits that as per Section 311 of Cr.P.C., Court may at any stage of proceedings can -l
re-summon any person, if his evidence appears to be essential for just decision in the case Hence, prayed to allow the petition. 5.
ln view of the said submission, to give one more opportunity to the petitioner and for proper adjudication of the matter, this . Court is inclined to allow the Criminal petition by setting aside the impugned order. The trial Court is directed to issue summons to PWs.1 and 2 by fixing a date and the learned counsel appearing for the petitioner/accused in the trial Court is directed to cross examine pWs.l and 2 on the date specified bythe trial Court, in default, their evidence stands closed.
Accordingly, this Criminal petition is allowed oMiscellaneous applications, if any pending, shall also stand closed.
