THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3139 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.1 & 10 to 15 seeking to quash the proceedings against them in CC No.9 of 2016 on the file of the Additional Judicial Magistrate of First Class, Kavali, SPSR Nellore District.

The allegations against the petitioners are that A1 created fake pattadar pass books to the lands of LWs.1 to 7 on the names of A1 and A9 to A15 with the assistance of A2 & A3 and used the same as genuine and got bank loans from the State Bank, Vinjamuru with the assistance of A4, A7 and A8.

Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to interfere with the proceedings against the petitioners in the above CC. At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners 1 and 7, who are aged persons and petitioner No.6, who is a lady, before the trial Court. In view of the above submission, the presence of the petitioners 1, 6 and 7 before the trial Court is dispensed with, except on the dates on which the trial Judge insists for their presence. The petitioners are directed to be represented through a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J March 11, 2016.
