Heard Sri Bethi Venkateshwarlu for petitioner and the learned Assistant Government Pleader (Revenue).

The 3rd respondent through order D.Dis.No.B/ 982/ 2015 dated 11.12.2015 while rejecting the appeal of petitioner, considering the eligibility and desirability to assign land to petitioner gave following directions :- " In the circumstances reported above I do not find any reason to interfere with the orders of Tahsildar, Bestavaripeta issued in Rc.A/ 391/ 2014, dt.05.12.2015. However, the appellant is very poor and he is eligible for assignment of land, he can be granted Govt. land in the vacant land in S.No.957/ 2 and 957/ 3 of Galijerugulla village. The appellant is directed to apply for assignment of land in the S.No.957/ 2 and 957/ 3 of Galijerugulla village or in any other suitable vacant Govt. land which is fit for cultivation and on receipt of the application from the appellant the Tahsildar, Bestavaripeta is requested to process the file and take appropriate action duly following the procedure under BSO-15 and after placing the proposal in Assignment review committee. The appeal is disposed of accordingly."

The petitioner in obedience to the conclusion excerpted above, on 01-02-2017, represented to the 5th respondent for grant of assignment in his favour.

Now the grievance is that in spite of clear cut directions from the 3rd respondent and also representation made on 01.02.2017, the 5th respondent is not doing the needful. Hence, the writ petition.

I have gone through the papers available on record and prima facie, I am satisfied that the inaction pointed out in this writ petition is made out and the 5th respondent can be directed to examine the representation dated 01-02-2017 and dispose of the same in accordance with law.

Hence, the writ petition is disposed of by this order. (1) The petitioner is given liberty to re-submit representation dated 01-02-2017 by enclosing a copy of this order within two weeks from today. (2) The 5th respondent is directed to look into the grievance and pass orders in accordance with law within two months thereafter and communicate to petitioner.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
