O R D E R
Aggrieved by the inaction of the respondents 2 and 3 - police authorities, in conducting investigation in Cr.No.245 of 2016 dated 29.11.2016, which was registered based on her complaint, the present writ petition is filed. Learned Assistant Government Pleader for Home produced written instructions of Sub-Inspector of Police, Bichukunda Police Station, Kamareddy District, dated 15.03.2019, wherein it is stated that the above crime was investigated and the dispute was found to be of civil in nature and after obtaining the opinions from the Assistant Public Prosecutor, Bichukunda and from the Deputy Superintendent of Police, Banswada, the case was referred as 'civil in nature' and final report was filed before the court of Judicial First class Magistrate, Bichukunda on 15.03.2019, and notice was also sent to the petitioner through registered post on 15.03.2019.
Along with the written instructions, learned Government Pleader for Home produced copy of the postal receipt showing that the notice was sent to the petitioner through registered post. But acknowledgement was not filed. Learned counsel for the petitioner also disputed the receipt of any notice. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.
Having regard to the facts and circumstances of the case, respondent No.3 shall serve copy of the final report to the petitioner through registered post with acknowledgement due, and file before the court concerned, if not already filed.
It is open to the petitioner to avail alternative remedies available under law.
The writ petition is accordingly disposed of. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
