THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.25074 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an appropriate Writ, Order or Direction, more particularly In the nature of Writ of Mandamus declaring the in-action of the 3rd Respondent in not registering FIR in C.C.Sr.No.4534 of 2014 on the file of 17th Addl. Chief Metropolitan Magistrate, Nampally, Hyderabad and failed to conduct the enquiry as illegal and arbitrary besides being violative of Fundamental Rights Guaranteed to the Writ Petitioner under Articles 19, 21 and 300-A of the Constitution of India and consequently direct the 2nd and 3rd Respondents herein to register the FIR in C.C.Sr.No.4534 of 2014 on the file of 17th Addl. Chief Metropolitan Magistrate and conduct thorough and comprehensive enquiry about the cheating and fraud played by the 4th and 5th Respondents on the Writ Petitioner and pass such other Order or Orders as this Hon'ble Court may deem fit and proper in the circumstances of the Case."

When the matter is called today, written instructions dated 18.08.2015 furnished by the Station House Officer, Jubilee Hills Police Station, have been placed on record by the learned Government Pleader for Home and the said instructions read as under: "It is respectfully submitted that the writ petition was filed by the petitioner seeking the direction to declare the in-action of the 3rd Respondent in not registering FIR in C.C.Sr.No.4534 of 2014 on the file of 17th Addl. Chief Metropolitan Magistrate, Nampally, Hyderabad and failed to conduct the enquiry as illegal and consequently direct the 2nd and 3rd Respondents herein to register the FIR in C.C.Sr.No.4534 of 2014 on the file of 17th Addl. Chief Metropolitan Magistrate and

conduct thorough and comprehensive enquiry about the cheating and fraud played by the 4th and 5th Respondents on the Writ Petitioner.

It is respectfully submitted that, on 17.08.2015 at 1100 hours this respondent police received a court referred complaint which was filed by the petitioner herein against the respondent Nos. 4 & 5 stating that the accused A1 & A2 cheated the petitioner that they will give opportunity as producer in Telugu Film "ALIAS JANAKI" and asked to pay about Rs.35,00,000 to Rs.40,00,000/- and not treated as Producer as promised, therefore, requested to take necessary action. After perusal of the complaint, this respondent registered a case in Crime No.562 of 2015 U/s.420,406.409,120-B IPC & 156(3) Cr.P.C. dated 17.08.2015 and took up the investigation."

3. On noticing the said written instructions, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the said instructions.

4. In view of the above, writ petition stands disposed of, by recording the written instructions dated 18.08.2015 furnished by the Station House Officer, Jubilee Hills Police Station.
