THE HON'BLE SMT JUSTICE T.RAJANI M.A.C.M.A.NO.968 OF 2006 JUDGMENT:

This appeal is preferred by the appellant, who is the claimant before the Court below assailing the judgment of the XII Addl. Chief Judge, City Civil Court, Hyderabad (Fast Track Court), dated 13-12-2005 in O.P.No.633 of 2002 on the grounds that the Court below did not award any amount under Ex.A5, which are the medical bills, which are filed along with Ex.P9. 2.

Heard the learned counsel for the appellant. None appears for the respondents.

A perusal of the judgment of the Court below shows that the learned Judge did not take up any discussion on Ex.A5, which are bunch of medical bills, to a tune of Rs.59,000/-. Counsel for the appellant also does not assail the judgment on any other grounds. The only ground raised is that the medical bills are totally ignored. Hence, the judgment needs to be rectified. 4.

The judgment of the Court below is modified by awarding a sum of Rs.59,000/- in addition to Rs.1,36,200/- which was awarded by the Court below, thereby making the award Rs.1,95,200/-.

Accordingly, this appeal is partly allowed with proportionate costs enhancing the compensation from Rs.1,36,200/- to Rs.1,95,200/-. This award shall relate back to the date of the decree and the enhanced compensation shall carry interest at the rate specified and from the time indicated in the award of the Court below. Miscellaneous petitions, if any pending, in this appeal shall stand closed.
