THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29501 OF 2011 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in granting permission in favour of the 3rd respondent to construct a building in the petitioner's land admeasuring 73 Sq.Ys. in Plot No.49 in Sy.Nos.41, 42, 43 & 46, covered under Block No.6, situated at Vani Nagar, Quthbullapur Circle, Hyderabad, vide permit No.5055/DC/NZ/Cir-15/11, dated 27.08.2011, as illegal and arbitrary and consequently to set aside the above said permit.

Heard learned counsel for the petitioner and Sri Ch.Madhu, learned Standing Counsel for respondent Corporation. When the matter came up for admission on 04.11.2011, no interim order was granted by this Court. Now, the learned counsel for the petitioner submits that the 3rd respondent has already completed the construction in pursuance to the permission granted by the 2nd respondent. Since the construction is completed the cause does not survive. However, it is open for the petitioner to avail appropriate remedies available to him under law against the 3rd respondent. Accordingly, the writ petition is closed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
