Heard Sri Atluri Radhakrishna, Secretary of the petitioner Association, who appeared as party-in-person, and Sri Pasham Krishna Reddy, learned Standing counsel for Municipal Corporation.
Petitioner herein is a welfare association. According to the petitioner, Sri Lakshminagar Colony located in I.S. Sadan division of Greater Hyderabad Municipal Corporation (for short, 'GHMC'), Hyderabad, came into existence 45 years back pursuant to the layouts approved by the competent authorities. It is the case of the petitioner that in the said approved layouts certain open places were earmarked for parks and one of which is located in Road No.8 of Sri Laxminagar Colony.
It is stated in the affidavit filed in support of the writ petition that few years ago GHMC constructed a big building by destroying more than half of the developed park and entrusted the use of the same as a building to Senior Citizens Welfare Association of Saidabad zone in violation of rulings of the Hon'ble Supreme Court and this Court, which prohibit construction of any building for other purposes in the area earmarked for parks and lung space in the approved layouts. It is further stated that earlier on behalf of the petitioner association, one of its members, namely, Sri S. Chandrasekar Reddy submitted a representation, dated 04.06.2016, for redressal of the subject grievance, but, according to the petitioner, party-in-person, no action has been taken by the respondent Municipal Corporation on the said representation.
Chandrasekar Reddy also submitted another application on 22.02.2017.
On the other hand, it is submitted by the learned Standing counsel for the respondent Municipal Corporation, Sri P. Krishna Reddy, that the said representation, dated 04.06.2016, will be verified and appropriate action will be taken in accordance with law, after giving personal hearing to the petitioner. In view of the above, the writ petition is disposed of, directing the respondent Municipal Corporation to verify the representation, dated 04.06.2016, said to have been submitted by Sri S.Chandrasekar Reddy, a member of the petitioner association, and take appropriate action in accordance with law, as expeditiously as possible, after giving opportunity of hearing to the petitioner. No order as to costs.
