- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.5416 OF 2019 ORDER :

Heard learned counsel for the petitioners, Sri R. Vinod Reddy, learned Standing Counsel for Telangana State Southern Power Distribution Corporation Limited appearing for respondents 1 to 4 and Sri Sampath Prabhakar Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation (GHMC) appearing for respondent No.5.

2.

In this writ petition the 3rd petitioner is the absolute owner of house bearing No.2-56/13/1 admeasuring 280 Square yards situated at Chanda Naik Thanda, Izzathnagar, Khanamet Village, Serlingampally Mandal, Ranga Reddy District. He entered into development agreement through registered agreement deed dated 14.06.2018 with petitioners 1 and 2. Petitioners claim that as construction of individual houses were completed in the above house number, they have applied for providing electric power supply connections to their houses, but so far the power supply connection is not provided to their houses and the applications are not accepted on the ground that the State Government and the GHMC are opposing to provide electric power supply connection to any property located in Sri Swamy Ayyappa Cooperative Housing Society Limited.

3.

It is seen from the material on record that so far petitioners have not applied for providing electric power supply connections. Therefore, they cannot allege that the respondent - Company is not providing power supply connections.

- 3 - 4.

In view of the same, the Writ Petition is accordingly disposed of giving liberty to the petitioners to apply for electric power supply connections by complying all the norms as required by the respondent - Company. As and when such applications are made, the respondent - Company is directed to provide individual service connections to the houses of petitioners within a period of four weeks from the date of submission of such applications and provision of such power supply connections shall be subject to further direction that may be issued by the State of Telangana or the Supreme Court in the litigation pending before it arising out of the judgment dated 12.09.2012 in W.P.No.20407 of 2008 and batch. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
