ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused in FIR No.52 of 2026 before the Kothapalli Police Station, Karimnagar District, registered for the offences punishable under Sections 108, 85 of the Bharatiya Nyaya Sanhita (for short 'BNS') and Under Sections 3 and 4 of the Dowry Prohibition Act, 1961.

The case of the prosecution is that the de-facto complainant, lodged a report before the police on 02.02.2026 stating that the marriage between the petitioner and the deceased was solemnized in the year 2016 and they were blessed with two children. It is further stated that the petitioner has harassed the deceased physically and mentally for additional dowry of Rs.5,00,000/-, due to such harassment, the deceased has committed suicide by consuming poison on 02.02.2026 and died on 03.02.2026 while undergoing treatment. Hence requested the police for taking necessary action. On receipt of the said complaint, the Police registered case for the offences as alleged. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioner.

Heard Sri Madas Bharath Chandra, learned counsel for the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations. In fact the deceased was suffering from mental disability and was

undergoing treatment for her mental disorders. It is further submitted that the deceased allegedly administered poison to her children, they were fortunately survived after receiving medical treatment. The petitioner is presently responsible for taking care of the children and will co-operate with the Investigating Officer during the course of the investigation. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner herein are severe in nature and due to the harassment of the petitioner herein, the deceased committed suicide, as such the petitioner herein is not entitled to grant bail. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is the husband of the deceased. As seen from the record, the deceased was suffering from mental disability and was undergoing treatment at various hospitals.

Considering the facts and circumstances of the case, and having regard to the fact that the two children require the care and custody of the petitioner, this Court deems it fit to grant prearrest bail to the petitioner, subject to compliance of the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Kothapally Police Station, Karimnagar, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
