HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8469 of 2015 ORDER :
This criminal petition is filed by the petitioners/A.1 to A.4 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.615 of 2015 of Malkajgiri Police Station, Cyberabad, registered for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
2. Heard the learned counsel for the petitioner and the 1st respondent-State represented by the Public Prosecutor, before admission and before ordering any notice to the 2nd respondent and perused the material on record.
3. A perusal of the material falls short to admit the criminal petition or to quash the F.I.R., but for to say the petitioners/A.1 to A.4 are entitled to the concession of bail, because there is a mediation agreement dated 09.07.2015 in O.P.No.513 of 2015 on the file of the Mediation Centre, Secretary, District Legal Services Authority, Ranga Reddy District at L.B.Nagar, wherein the parties agreed to live together and there is a divorce O.P.No.553 of 2015 pending before the Judge, Family Court, Ranga Reddy District at L.B.Nagar.
4. Hence, this criminal petition is disposed of giving liberty to the petitioners/A.1 to A.4 to surrender before the
learned Magistrate concerned and move for regular bail with notice to the A.P.P. concerned and in such an event and after hearing the Public Prosecutor concerned, the learned Magistrate shall grant bail with necessary conditions on the same day.
The presence of the petitioners/A.1 to A.4 is hereby dispensed with at post bail stage and pending investigation. Further remedies are left open to the petitioners after police filing final report and cognizance taken by the learned Magistrate.
5. Miscellaneous petitions pending, if any, shall stand closed.
