THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4493 OF 2018 O R D E R:

This Writ Petition is filed to declare the preliminary notification dated 16.05.2017, Section 19(1) declaration dated 02.12.2017 and the proceedings dated 24.11.2017, whereunder the objections of the petitioners were rejected, as illegal and arbitrary.

It is brought to the notice of this Court by the learned counsel for the petitioners that in identical facts and circumstances, Writ Petition No. 7016 of 2017 and batch of cases have been filed questioning the notification issued under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and further notifications under Sections 15 and 19 of the said Act, and this Court vide common order dated 30.08.2017, partly allowed the Writ Petitions setting aside the declarations under Section 19(1) of Act 30 of 2013 and giving liberty to the petitioners to raise objections under Section 15(2) of the said Act. Learned Government Pleader for Revenue (Andhra Pradesh) does not dispute the above-said submission.

In those circumstances, without expressing any opinion on the merits of the matter, this Writ Petition is allowed partly, setting aside the declarations issued under Section 19(1) of the 2013 Act, giving liberty to the petitioners to raise objections under Section 15(2) of Act 30 of 3013. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
