THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.384 OF 2011 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ of Mandamus, declaring action of the 5th respondent in refusing to send the "No Objection Certificate" (NOC) along with his report directly to the 2nd respondent about the classification and availability of land applied by the petitioner in his application dated 15.11.2010 for grant of quarry lease in S.No.412 of Munollapalle Village, Kalikiri Mandal, Chittoor District to and extent of 2.994 Hectors as illegal, improper, unjust, and arbitrary and contrary to G.O.Ms.No.181 (Ind. & Com (Mines-1) Dept; dated 28.5.1998 and pass such other order or orders as this Hon'ble Court may fit and proper in the interest of justice."

2. Heard sri Mahadeva Kanthrigala, learned counsel, appearing for the petitioner and learned Government Pleaders for Mines and Geology and Home, appearing for the respondents.

3. A counter affidavit is filed by the Tahasildar, Karvetinagar Mandal, Chittoor District. Paragraph 5 of the said counter states that the grievance of the petitioner has already been redressed and since the Tahasildar has issued No Objection Certificate to the Assistant Director of Mines and Geology, it is for the Mines Department to grant lease permission as per the request of the petitioner.

4. While referring to the said averments, it is stated by the learned counsel for the petitioner that in view of the said averments in the counter, no further orders are required to be passed in the present writ petition.

5. Recording the said submission, Writ Petition is closed. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
