O R D E R
This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.11 in FIR No.57 of 2026 of Medipally Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 329(4), 324(4), 109 r/w 3(5) of the BNS. 2.
The case of the prosecution is that, on 11.01.2026, the de-facto complainant lodged a report before the police stating
- 2 - that on 10.01.2026 he along with other plot owners of Ekasila Nagar, Narapally and others were cleaning their plots and in the meantime, accused Nos.1 to 9 and others alleged that said plots belongs to A. Venkatesh and started attacking them. In fear of the above accused, complainant and others rushed into the house of Shiva Reddy and locked themselves from inside. But the accused criminally entered into the house by breaking the door informing that they are the henchmen of A. Venkatesh and stabbed with knives and beat with rods, due to that complainant received injuries to his head, nose and Mohd. Azhar received injuries to his head. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri Y. Shashidhar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the name of the petitioner herein was not mentioned in the FIR and subsequently, he was added only to falsely implicate him
- 3 - in the present case and there are no specific allegations against him and he is innocent of the said allegations and accused Nos.1 and 9 were already granted bail by the trial Court and he is in jail since 12.01.2026. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the petitioner herein is an instrumental in implementing the plan executed by accused No.1 and at the instance of accused No.1, all the other accused went to the scene of offence and they have committed the offence. Further, the investigation was not yet completed and earlier, the petitioner herein was involved in another Crime No.03 of 2018, as such, he is not entitled for the bail and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since
- 4 - 12.01.2026. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 21 have already been examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned I Additional Junior Civil Judge-cum-V Additional JFCM, Medchal-Malkajgiri, at Medipally.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of
- 5 - investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
