ORDER:
This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused No.10 in Crime No.15 of 2026 before the Nizamabad IV Town Police Station, Nizamabad District, registered for the offences punishable under Sections 308(2), 308(3) r/w 61(2) of the Bharatiya Nyaya Sanhita (for short 'BNS').

The case of the prosecution is that the de-facto complainant, lodged a report before the police on 12.01.2026
stating that the de-facto complainant has appointed one Kothapally Ajay as the Branch in-charge and tasked with the marketing activities of the institute. The complainant, head of Reyansh Institute, terminated him due to his poor performance. Thereafter, Ajay threatened and blackmailed the complainant, damaged institute property, and extorted Rs. 7 lakhs. Subsequently, Suresh (cameraman, Akshara Newspaper) and Vijay (Bureau Head) made false allegations against the institute and demanded Rs.10 lakhs to suppress publication. Under pressure, Rs.5 lakhs was paid through the complainant's brother to them. Later, Raju Goud and Ravinder Goud (Student Union) demanded Rs. 2 lakhs, for which Rs.1 lakh was paid under coercion. Further, Mogili demanded Rs.
50,000, wherein the de-facto complainant refused to pay him, for which Mogili and Diwakar (TV9 reporter) made additional allegations and sought a meeting, as such requested the police for taking necessary action. On receipt of the said complaint, the Police registered a case for the above said offences. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioner.

Heard Sri M. Venkata Swamy, learned counsel for the petitioner as well as Sri M. Ramachandra Reddy, learned
Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is arrayed as accused No.10, even according to the complainant, no amount is given to the petitioner directly by the de-facto complainant and the petitioner has been falsely implicated in this case. It is further submitted that all the other accused were granted bail by this Court, as such the petitioner may be granted bail in the similar footing. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner contending that the allegations against the petitioner are grievous in nature and there are specific allegations against the petitioner. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is arrayed as accused No.10 and there are no specific allegations against the petitioner of having
demanded any amount, nor is there any allegation that the defacto complainant handed over any such amount to the petitioner. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to compliance of the following conditions: i.
The petitioner shall surrender before the Station House Officer, Nizamabad IV Town Police Station, Nizamabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending, shall stand closed.
