THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1943 OF 2016 ORDER:

This Criminal Petition is filed by the accused No.2, 4 to 8 and 12 under Section 482 Cr.P.C. seeking to quash the proceedings in PRC No.21 of 2015 pending on the file of First Class Judicial Magistrate, Nandyal for the offences under Sections 147, 148, 452, 342, 506, 427 r/w 149 IPC and Section 3(1)(x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The grounds now raised by the learned counsel for the petitioners for quashing the impugned proceedings are all disputed questions of facts which can be adjudicated by the trial Court only after full-fledged trial. Hence, this Court is not inclined to interfere with the impugned proceedings at this stage. Now, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the petitioners before the trial Court as they are students.

In the result, the Criminal Petition is dismissed. However, the presence of petitioners before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance. They are directed to be represented by a counsel on all hearing dates.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
