HONOURABLE SRI JUSTICE N.V.SHRAVAN KUMAR WRIT PETITION (TR) No. 2437 OF 2017 ORDER:

This present writ petition(TR) is filed seeking to declare the impugned Proceeding No.A2/6471/2012, dated 06.06.2014 of the 1st respondent and Circular Memo No.35252/Ser.G/A1/2011-1, dated 04.12.2013 of the 4th respondent, wherein, rejecting the case of the applicants for compassionate appointment to the dependants of the deceased employees restricting them to appoint in their own local bodies where their parents were died in the particular local bodies is highly illegal, arbitrary and without any application of mind and declare the same as bad in law and set-aside the same and consequently direct the respondents to consider the cases of the applicants for appointment under compassionate grounds for any suitable posts in the existing vacancies in Adilabad District. 2.

Learned counsel for the petitioners submits that petitioner No.1 father i.e., Sri.Naganath died on 20.07.2010 and petitioner No.2 father i.e., Sri.Satyanarayana, died on 27.02.2010.

Subsequently, after the death of petitioners' father, the petitioners made applications to the respondent authorities on 15.09.2010 and 07.05.2010 respectively, for compassionate appointment, but the respondents authorities have not considered the same.

Learned Government Pleader appearing for respondents submits that the counter has been filed by the respondent authorities, wherein it is stated that the candidature of the applicants will be considered as and when petitioners turn come up based on seniority and duly following Rule of Reservation under ZPP Management, Adilabad.

The learned counsel for the petitioners submits that till date the petitioners candidature was not considered and prays this Court to direct the respondent authorities to consider the petitioners applications for compassionate appointment and pass appropriate orders, within a time bound period.

Learned Government Pleader appearing for respondents submits that the respondent authorities may be directed to consider the petitioners application and pass appropriate orders, in accordance with law.

In view of the submission made by the learned counsel on either side and considering the facts and circumstances of the case, this writ petition(TR) is disposed of and the respondent authorities are directed to consider the case of the petitioners for compassionate appointment, by taking into consideration seniority and duly following Rule of Reservation under ZPP Management, Adilabad as and when petitioners turn comes for consideration and

pass appropriate orders and communicate the same to the petitioners.

Accordingly this Writ Petition(TR) is disposed of.

Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
