THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.12873 of 2016 ORDER:

The petitioners-accused Nos.18 and 19 preferred the present Criminal Petition under Section 440 (2) of the Code of the Criminal Procedure (Cr.P.C.), seeking relaxation of the condition imposed in order dated 11.08.2016 in Crl.M.P.No.997 of 2016 passed by the Sessions Judge, Krishna, Machilipatnam, in connection with Crime No.163 of 2013 of Eluru II Town Police Station now under CID, Rajahmundry. Heard.

Vide order dated 11.08.2016, the petitioners were granted bail by the learned Sessions Judge on condition of their executing bond for a sum of Rs.2,00,000/- each with two sureties for the likesum each to the satisfaction of Sessions Court. Learned Sessions Judge also imposed certain other conditions on the petitioners. However, feeling aggrieved by the said order to the extent of directing the petitioners to furnish two sureties for a sum of Rs.2,00,000/-, present petition is preferred. Having regard to the reasons stated in the petition and also the submissions of both sides, petitioners are directed to furnish each two sureties for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each. Further, out of two sureties, one surety must be a local surety. It is made clear that the impugned order is modified only to this extent and the other conditions stipulated in the impugned order remain unaltered.
