HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.4513 of 2015 ORDER:

Heard.

The petitioner states that it is carrying on business of Black Jaggery and Alum in the name and style of M/s.Manasa Kirana General Stores at the premises bearing H.No.25, Maheshwaram Village and Mandal, Ranga Reddy District. The petitioner states that it has requisite licence and it has been purchasing Black Jaggery and Alum from various customers and selling the same under valid bills. The petitioner states that on 01-02-2015 the 3rd respondent summoned the representative of the petitioner and threatened him to close down the business.

The petitioner also states that on 20-02-2015 respondents 3 and 4 have jointly raided the business of the petitioner and asked it to close down the business.

Alleging that the respondents are interfering with its business and also threatening it with regard to seizure of stock and closure of business, the petitioner filed the present writ petition.

Learned Government Pleader has received instructions from the Inspector of Police, Maheshwaram Police Station, Cyberabad, wherein it is stated that as of now no complaint or case is registered against the petitioner and that the respondents never interfered with the lawful business carried out by the petitioner nor summoned the petitioner on 01-02-2015 nor raided the premises as alleged by the petitioner. It is further stated that on enquiry, it is revealed that to prevent the police and excise officials from taking any action against the petitioner in future, the present writ petition is filed.

Since it is evident that no case or complaint is filed against the petitioner and as the respondents stated that they never interfered with the lawful business carried out by the petitioner, the writ petition clearly

appears to be filed based on apprehension. Hence, no further orders are necessary as sought for. However, if the petitioner is found involved in any case committed under the A.P.Excise Act, the respondents are at liberty to take appropriate action against the petitioner in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
