KESHAVA RAO WRIT PETITION No.19779 of 2017 ORDER : (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, petitioner has challenged the detention order dated 19.04.2017 and the subsequent order dated 09.06.2017, passed by the respondents.

In the grounds of detention, it is specifically stated that the detenu was arrested in Crime No.91/2016 of Lakkireddipalli Police Station and was granted bail on 13.03.2017. After being released on bail, the detenu continued to involve in similar activities, which are prejudicial to the public order. However, it is contended by the learned counsel for petitioner that the detenu was not released from the Jail. 3.
The fact remains that the detenu was not released from the jail in connection with the above case and this fact is admitted by the learned Government Pleader appearing for respondents. 4.
In view of above, as the detenu was not released from jail, the question of his indulging in similar activities, does not arise. 5.
Therefore, we hereby set aside the detention order dated 19.04.2017 and the subsequent order dated 09.06.2017, passed by the respondents. Consequentially, the Superintendent, Central Prison, Kadapa, YSR Kadapa District is directed to release the detenu forthwith, if not required in any other criminal case.
