HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.32053 of 2016 ORDER:
Vide present writ petition, the petitioner seeks a direction, thereby directing the 2nd respondent not to disburse the compensation to third parties in respect of lands in Sy.No.727/ D in an extent of Ac.4.50 cents situated at Gani Village, Gadivemula Mandal, Kurnool District, till the matter is referred to the Authority constituted under Section 77-(2) of the Act 20 of 2013.
2. Learned counsel appearing for the petitioner submits that for the aforesaid purpose, the petitioner sent a legal notice dated 03.08.2015 through Sri M. Uma Maheswar Reddy, Advocate, however, till date the said legal notice has not been decided.
3. Learned Government Pleader for Revenue (AP) appearing on behalf of the respondents, submits that there is no acknowledgment of the legal notice mentioned above by the respondents.
4. Be that as it may, the legal notice is at page 25 of the writ affidavit. If the respondents have not received the notice, the copy of the legal notice in the writ petition be treated as received by the respondents.
5. Accordingly, respondents 2 and 3 are directed to dispose of the legal notice dated 03.08.2015 issued by the petitioner through her counsel, within a period of four weeks from the date of receipt of a copy of this order and the decision taken thereon shall be communicated to the petitioner in writing within one week thereafter.
6. Needless to state if the petitioner is aggrieved with the action or inaction of the respondents, she is at liberty to approach appropriate forum available under law.
7. With the above direction, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition, shall stand closed.
